Fentanyl Tariff Reduction Officially Takes Effect! Reciprocal Tariffs Remain Suspended, Trump Tariff Case Heard in Court

Introduction

On November 4, local time, President Trump signed two executive orders, announcing the official implementation of the fentanyl tariff reduction and the continuation of the one-year suspension of reciprocal tariffs.

On November 5, local time, the U.S. Supreme Court held a hearing on tariff policy, during which Trump's tariffs faced extensive questioning from Supreme Court justices.

The following is the full text.


I. Fentanyl Tariff Reduction Officially Takes Effect

On November 4, 2025, President Trump signed an executive order announcing the reduction of additional ad valorem tariffs imposed on the synthetic opioid supply chain from the People's Republic of China, known as the fentanyl tariff, from 20% to 10%.

This adjustment will take effect at 12:01 a.m. on November 10, 2025 (Eastern Standard Time).

This decision is based on the outcomes of consultations between China and the United States regarding the issue of synthetic opioids, particularly fentanyl, entering the United States.

This executive order builds upon two previous orders:

① Executive Order 14195, issued on February 1, 2025, which initially imposed an additional 10% tariff on Chinese products;

② Subsequently, Executive Order 14228, issued on March 3, 2025, which increased the tariff rate to 20%.

This tariff reduction represents a positive response from the U.S. government to China's commitments to curb the flow of synthetic opioids, while also reflecting the progress in cooperation between the two countries on this critical security issue.


II. Reciprocal Tariffs Suspended Until November 10, 2026

On November 4, 2025, President Trump signed another executive order, announcing the continued suspension of higher reciprocal tariffs on imported goods from the People's Republic of China.

The suspension period has been extended until 12:01 a.m. on November 10, 2026 (Eastern Standard Time).

This decision is based on the Kuala Lumpur Joint Arrangement reached following the meeting between the top leaders of China and the United States in Busan, South Korea, on October 30, 2025. This arrangement has been described as a "historic major agreement" in China-U.S. economic and trade relations.

It covers multiple areas including rare earth export controls, the semiconductor industry, agricultural product trade, and tariff suspension, marking a new phase in China-U.S. economic and trade relations.


III. Trump Tariff Case Heard in Court

On Wednesday, November 5, local time, the U.S. Supreme Court held a hearing on the legality of President Trump's comprehensive tariff policy.

According to reports, during more than two and a half hours of arguments, Supreme Court justices from both sides took turns questioning representatives from both parties.

Both conservative and liberal justices sharply questioned the attorney representing the Trump administration about whether the 1977 law, intended for use during national emergencies, granted Trump the authority he claimed to impose tariffs, or whether the Republican president had encroached upon Congressional powers.

Chief Justice John Roberts stated during the hearing:

These tariffs are "taxes on Americans, and taxation has historically been a core power of Congress."

On October 30, local time, the U.S. Senate passed a resolution by a vote of 51 in favor and 47 against, calling for the cancellation of the "national emergency" invoked by the Trump administration to justify the so-called "reciprocal tariffs" introduced in early April.

The three liberal justices also expressed clear opposition to the tariff policy. For example, Justice Sotomayor stated bluntly: "The power to tax belongs to Congress, not the President. You want to say tariffs are not taxes, but tariffs are taxes."

Treasury Secretary Scott Bessent said on Wednesday that he felt "very, very optimistic" following the Supreme Court hearing on the legality of President Trump's comprehensive tariffs.

Bessent told Fox Business's "Kudlow" program that he believed the plaintiffs challenging Trump's use of the 1977 law to justify the tariffs "almost embarrassed themselves," and he is confident that the Supreme Court will overturn the lower court's ruling that the tariffs are illegal.

The Supreme Court is expected to issue a ruling on this case by the end of June 2026.
